ZONING ORDINANCE · BOARD OF ADJUSTMENT

### A. Responsibility: 1\. In accordance with Minnesota Statutes 462.351 to 462.364, the City Council shall serve as the Board of Adjustment. 2\. The Board of Adjustment shall hold meetings, keep minutes, and pursuant to notice, shall conduct hearings, take testimony under oath, and render decisions in writing within forty-five (45) days after the hearing or continued hearing. 3\. A fee shall be charged in accordance with a schedule adopted in Section 1- 2-2 of the City Code for any appeal or proceeding filed with the Board of Adjustment. ### B. Rule: 1\. The City Council, serving as the Board of Adjustment, shall have the power to hear and decide appeals where it is alleged that there is an error in any order, requirement, decision, or determination made by the City Clerk, Building Official, or Commission in the administration of this Chapter. 2\. An appeal shall be in writing and filed with the City Clerk. Within ten (10) days after filing of the appeal, the City Clerk shall transmit to the Board of Adjustment all papers involved in the proceedings. 3\. Upon receipt of this material, the Board of Adjustment shall set a hearing date and give notice by mail of the time, place, and purpose thereof to the appellant and to the Planning & Zoning Commission. 4\. The Board of Adjustment may reverse or affirm wholly or in part any ruling, decision, or determination and may issue or direct the issuance of a permit.
